Learned counsel for the appellant states that he has no instruction on behalf of the appellants.
The office report dated 20.02.2024 shows that the demand draft of Rs. 60.00 lacs, which was given to the appellant for revalidation, has not yet been deposited and waiver application is pending consideration.
The said report further records that no steps have been taken by the learned counsel for the appellants for service of notice upon the respondents inspite of previous order dated 28.11.2023, wherein it was directed that in case the appellants do not take steps for service of notice upon the respondents, appropriate order will be passed. Today as per office report, no steps has been taken by the appellants.
In view of the above, this court is of opinion that the appellants do not want to seek any relief against the respondents, therefore, the present appeal is dismissed with no order as to costs.
