Harshit Dinesh Mishra versus Aditya Birla Housing Finance Ltd.

This is a Misc. Appeal preferred by the appellants challenging the impugned order dated 13.01.2023 of the Debts Recovery Tribunal, Nagpur (D.R.T) in Securitisation Application (S.A.) No. 22 of 2023 declining to grant any protection to them in the interlocutory application (I.A.) filed as I.A. No. 2373 of 2022. The appellants have deposited the pre-deposit amount and the consequence to which the appeal shall be taken on file.

The Ld. Counsel appearing for respondent No. 1 submits that S.A. itself can be disposed of expeditiously and the Ld. Counsel appearing for the appellants agreed to that proposal.

Hence, the Misc. Appeal is disposed of with a direction to the D.R.T., Nagpur to dispose of the S.A. No. 22 of 2023 as expeditiously as possible at any rate within three months keeping open all the

contentions open and untrammelled by whatever is observed in the earlier order of the D.R.T. as well as the order of this Tribunal. The protection granted by this Tribunal shall continue till the disposal of the S.A.

Interlocutory applications, if any, are dismissed as infructuous.
