Smfg India Home Finance Ltd. versus Ramchandra Sadigale

This Misc. Appeal has been pending since 2022 and the Securitisation Application (S.A.) No. 260 of 2022 has also been pending consideration of the Debts Recovery Tribunal-II, Mumbai (D.R.T.)for the last more than two years. I am told that the S.A. is ripe for being heard and disposed of. It and therefore, in the interests of justice to dispose of the appeal without entering into merits, and leave it to the decision of the DRT.

The Misc. Appeal is disposed of with a direction that the S.A. be disposed of as expeditiously as possible at any rate within two months of receipt of the copy of this order. It is also observed that the Tribunal below shall not be influenced by the decision taken in the interlocutory order and shall keep the contentions open to be decided at the time of the final hearing. In case the pleadings are not completed before the D.R.T. which shall be completed within four weeks.
