Columbia Hospital and Research Center and Ors. versus Kotak Mahindra Bank Ltd. and Anr.

This is an application for speaking to the minutes concerning the order dated 27.09.2024 wherein this Tribunal had granted a stay to the pleadings before the recovery officer till the next date of hearing. It is pointed out that the appeal is preferred against the orders passed in the S.A. and that nothing is pending before the recovery officer. Therefore, it was a mistake that needs to be corrected. After hearing the Ld. Counsel appearing for the appellants, I find that this is only a mistake and therefore, paragraph 5 of the order stands corrected as thus: “Upon deposit of the 1^st instalment of the pre-deposit, the execution of the further Sarfaesi measures shall stand stayed till the next date of hearing.”

The certified copies issued shall be recalled for corrections.
