The matter is taken up for hearing by way of a praecipe filed by the appellant for seeking urgent relief.
The appellants have filed this application for an extension of time to pay the first instalment as pre-deposit which is payable today. The Ld. Counsel appearing for the appellants submits that the amount would be paid by Monday i.e. the 7th instant.
The application for extension has been vehemently opposed by the Ld. Counsel appearing for the respondent bank stating that the appellants are not bonafide in filing the application for extension and they are only used for getting time extension.
However, considering the facts and circumstances of this case and in view of the fact that the appellants seek time only till Monday to pay the first instalment, the application is allowed. The first instalment

shall be paid on or before 07.10.2024.
Post on 08.10.2024 for reporting compliance regarding the first instalment.
