Learned counsel for the respondent-Bank submits that the notice under section 13(2) of the SARFAESI Act has been quashed by the Hon’ble Calcutta High Court in W.P. No. 580/2024- Sri Din Dayal Kayan Vs. Canara Bank & Anr. vide order dated 09.07.2024, therefore, the present appeal has become infructuous.
In view of the above, the appeal is dismissed as having become infructuous.
