Shri Shan Mohammad Ali, holding brief of Shri W.A. Siddique, Ld. Counsel for the appellant is present and submits Rs. 425/- towards deficit court fee. Ld. Counsel also submits typed copy of pages No. 41, 58, 60 and certified copy of page no. 75. Defects reconciled. Proper court fee paid.
No Pre-deposit has been made by the Appellant. A waiver Application being I.A. No. (43/2023) has been filed stating that appellants are the third party and prayed that condition of pre-deposit may be waived.
The instant Appeal has been filed under section 18 of the SARFAESI Act against final order dated 09.12.2022 of DRT, Lucknow in S.A. No. 374/2013. Waiver Application (I.A. No. 43/2023), Stay Application (I.A. No. 44/2023) have been filed along with the Appeal.
