VideRegistry bench order dated 14/06/2023 Ld. Advocate for appellant was directed to appear on 16.06.2023 and remove the following two defects.

(i) Certified copy of impugned order dated 08/10/2021 has not filed with the appeal. True copy of the order is filed. (ii) Respondent Nos. 2 & 3 is not party in S.A. No. 355 of 2021. However they are included as Respondent 2 & 3 in this Misc. Appeal DY. No. 350 of 2023.

But none appears on 16.06.2023. Hence the matter was posted again on 28.06.2023.

Ld. Advocate Mr. Anjan Kumar Paul representing appellant appears on 28.06.2023 and submits that in respect of defect mentioned in Sl. No.(i), the copy of impugned order annexed to the memorandum of appeal may be treated as certified copy as the copy of order annexed to the appeal is true of the original documents and in regard to defect at Sl. No. (ii) Ld. Advocate submitted that due to inadvertent mistake Respondent No. 2 & 3 has been added as party in this appeal and prays for time to file an amendment petition to expunge their name.
