Shri Ashutosh Shukla, Ld. Counsel for the appellant is present. Fee on Vakalatnama has been paid by the Ld. Counsel for the appellant.
As regard to pre-deposit, appellant has paid Rs. 7.00 lakhs through Demand Draft on 28.04.2023 before this Tribunal. Further in the Waiver Application he has submitted that the appellant has deposited Rs. 2.00 lakhs through Demand Draft dated 11.04.2023 along with the OTS Application with the respondent-Bank and prayed to grant Waiver for rest of the amount. In terms of notice dated 24.12.2018 under section 13 (2) annexed at page No. 59 of the Appeal, the total outstanding amount is 26,86,388.46 and the 50% amount of predeposit comes to 13,43,194.23.
The Ld. Counsel for the appellant has prayed that he will argue before the Hon’ble Court on Waiver Application and prayed that the case may be placed before the Hon’ble Court.
The present appeal has been filed under section 20 of the RDB Act against the final order dated 02.02.2023 passed by DRT, Patna in O.A. No. 448/2020. Waiver Application (I.A. No. 307/2023) and Delay Condonation Application (I.A. No. 308/2023) has been filed.
