Smt. Vidya Maurya & Ors. Vs. Bank of Maharashtra & Ors.
Vide order dated 03.03.2023, the appellant was directed to deposit 25% of the amount due, failing which the appeal shall stand dismissed without further reference to the court and in case of compliance, the case was directed to be listed on 25.05.2023. Thereafter, the appellant filed an urgency application, which was rejected vide order dated 02.05.2023, but the case was inadvertently directed to be listed on the date already fixed i.e. 25.05.2023. Accordingly, the case was listed today, whereas as per order dated 03.03.2023, the appeal was to be treated to have been dismissed in case of non-compliance of the said order. As per office report dated 24.05.2023, the appellant has not deposited any amount pursuant to the order dated 03.03.2023 of this Tribunal, therefore, the appeal is treated to have been dismissed in view of the earlier order dated 03.03.2023 passed by this Tribunal.
