Heard the learned counsel for the appellant.
Learned counsel for the appellant submits that the Hon’ble Apex Court vide order dated 24.04.2023 passed in SLP No. 7084-7089/2023 – Shipra Estate Ltd. Vs. Indiabulls Housing Finance Ltd. & Anr. has dismissed the SLP filed by the appellant with the liberty to pursue remedies under the SARFAESI Act.
It is contended that the appellant has already filed the application before the Tribunal below under the SARFAESI Act in view of the order passed by the Hon’ble Apex Court, therefore, he wants to withdraw the present appeal.
In view of the submission made by the counsel for the appellant, the present appeal is dismissed as withdrawn. No order as to costs.
