Learned counsel for the respondent-bank submits that against the order impugned in the present case, the Bank had also filed the Appeal Dy. No. 798/2023, which was disposed off by this Appellate Tribunal vide order dated 31.10.2023 remitting back the matter to the Tribunal below. Photocopy of the said order has been produced by the learned counsel for the respondent-Bank before this Tribunal, which is taken on record. Learned counsel for the respondent-Bank further submits that the appellant-borrower has filed the present appeal against the same order, therefore, the present appeal may also be disposed off on the same terms as contained in the order dated 31.10.2023, by which Appeal Dy. No. 798/2023 filed by the Bank was disposed off.

The learned counsel for the appellant-borrower has no objection to the submissions made by the learned counsel for the respondents-Bank provided that the interim protection granted by this Tribunal vide order dated 12.07.2023 may continue till the disposal of the proceeding before the Tribunal below, which has not been objected by the counsel for the respondent-Bank.

In view of the above, the present appeal stand disposed off on the same terms as contained in the order dated 31.10.2023 passed by this Appellate Tribunal in Appeal Dy. No. 798/2023 filed by the respondent-Bank and the interim order granted by this Tribunal vide order dated 12.07.2023 shall continue till the final disposal of the proceedings pending before the Tribunal below.
