Shri V.K. Shukla Learned Counsel for the appellant appears and removes the defects as pointed out by the registry in the manner as follows:-
- The signed copy of memo by the appellant has been filed separately in proper format wherein relief has been sought which were not sought in the earlier Appeal.
- Non judicial stamps for Rs. 10 which have been provided.
- With regard to pre-deposit, Learned Counsel for the appellant submits that the appellant has already deposited 27.5% of the demand raised by the Bank which is stated in the Para 6 of the Waiver Application. It is therefore, prayed by the appellant that for the rest amount, the matter may be referred before the Hon’ble Court for Waiver.
The present appeal has been filed under section 18 of the SARFAESI Act against the interim order dated 26.05.2023 passed by DRT, Jabalpur in S.A. No. 367/2023. An Urgency Application (I.A. No. 477/2023) Waiver Application (I.A. No. 476/2023) Stay Application (I.A. No. 475 /2023) have been filed.
