The 1st Appellant is the proprietary concern of Shri Amit Yeshwanthrao Kadam and the 2nd Appellant is the mortgagor. This is an appeal filed under section 20 of the Recovery of Debts Due to Banks & Financial Institutions Act, 1993 (‘RDDB & FI Act’, for short) challenging the judgment and order in Original Application (O.A.) No. 87 of 2009 on the files of the Debts Recovery Tribunal, Pune (D.R.T.) 2. The 1st Respondent Canara Bank had advanced a cash credit facility of ₹7 lakhs to the 1st Appellant vide sanction letter dated 16/03/2004. On disbursement of the debt, demand promissory note and other documents were executed.
