The appeal has been filed on behalf of Mrs. K. Suchetha Rani & Anr against the order dated 28/07/2017 passed in S.A. No. 1261 of 2017 in DRT-II, Hyderabad. Appeal fee of Rs.45426/- vide Transaction Ref. ID 2010230048683 dated 20/10/2023 has been paid through online along with the appeal.

The case is under the jurisdiction of this Appellate Tribunal.

It is stated in memorandum of appeal that the appellant had preferred a Writ Petition No. 26079 of 2017 before the Hon’ble High Court for the State of Telangana at Hyderabad against the impugned order dated 28/07/2017 in S.A. No. 1261 of 2017. Hon’ble High Court was pleased to direct in the said W.P. vide order dated 14/09/2023 (copy enclosed at page 28-35) that the petitioners shall be at liberty to file an appeal under section 18 of the Act before the Debts Recovery Appellate Tribunal and it is further directed that in case the petitioners file an appeal within a period of six weeks from the date of order i.e. on14/09/2023, the same shall be treated as filed within limitation and Debts Recovery Appellate Tribunal shall proceed to deal with the appeal on merits. Thus the Appeal is within the period of limitation.
