Learned Counsel for the Appellants, Mr. Sanjay Mitra, does not press the reliefs (a) (b) and (c) as prayed for in the Memo of Appeal. Learned Counsel submits that he is pressing the relief for counter claim only. Since only relief for counter claim is being pressed, there is no question of waiver of making pre deposit. Accordingly, the order dated 29th August, 2022 is hereby recalled.
