THE APPELLATE TRIBUNAL :
Learned Counsel places an order dated 17th February, 2023 passed by the Hon’ble High Court at Calcutta in WPA 2989 of 2022 wherein the writ petition was dismissed as withdrawn.
Learned Counsel submits that the Misc. Application for restoration of the O.A. was pending but the same was not considered by the Learned Debts Recovery Tribunal. Learned Counsel has placed reliance upon page 144A of the paper book wherein in on 21st February, 2014 the next date fixed was 21st March, 2014 but thereafter no copy of the order sheets are annexed with the paper book. Learned Counsel prays for and is granted two weeks time to file supplementary affidavit annexing all the copies of the order sheets.
List on 3rd April, 2023 for hearing.
