A mention has been made on behalf of the learned counsel for the appellant that the arguing counsel Shri Ashish Ganguli is indisposed today, therefore, he is unable to appear before this Tribunal, hence he seeks adjournment.
Learned counsel for the respondent-Bank submits that the present appeal is of year 2019, which is being continuously deferred and the fact that there is nothing in the appeal. It is luxury litigation. Learned counsel for the respondent-Bank has drawn attention of this court to the page no. 302 of the paper book, which is copy of the order-sheet and order dated 25.01.2019 records that the counsel for the defendant had pleaded before the Tribunal below that in the O.A., certain documents, which have been filed, are not legible, but he could not point out the same and it is also recorded in the said order that the counsel for the appellant read out those documents, which were stated to be illegible, in that event no further time was granted and the right of the defendant to file written statement was also closed and the matter was fixed for hearing, against which the present appeal has been filed. It is also argued that the present appeal is not maintainable and the matter may be remitted to the Tribunal below for its reconsideration.
As the arguing counsel on behalf of the appellant is indisposed today, the matter is being deferred. List this case on 12.12.2023 for hearing.
