THE APPELLATE TRIBUNAL :
Heard the Learned Counsel for the parties and perused the record. Learned Counsel for the Appellant submits that the loan account has fully been satisfied. Apart from the sale proceeds, other borrowers and guarantors have made deposits which are not being shown by the Bank. Further there is no balance shown in the account.
Learned Counsel for the Respondent Bank is hereby directed to file an affidavit to this effect as to whether any amount has been deposited by the other borrowers and guarantors under the loan account in dispute and what is the balance as on date in the loan account. Affidavit be filed within two weeks.
List on 13th June, 2023 for disposal of the waiver application.
