The office report dated 11.05.2023 shows that an amount of Rs. 10,22,926/- has been deposited by the appellant towards pre-deposit and no reply has been filed by the respondentBank to the waiver and delay condonation applications. The said report further reveals that no notice has been issued upon the respondent nos. 2, 3 & 4.
Let the notice be issued to the respondent nos. 2, 3 & 4 on the waiver and delay condonation applications by two modes i.e. Registered Post with A.D. and Speed Post. Steps to be taken by the appellant within a week. Affidavit of service along with tracking report be filed by the next date.
Learned counsel for the respondent-Bank submits that he has not been served with the copy of appeal. Learned counsel for the appellant submits that he shall serve the same upon the counsel for the respondent-Bank during course of the day, who may file reply by the next date fixed.
