Learned counsel for the appellant submits that the appellant has purchased the property from the Auction Purchaser, who had purchased the property from the respondent no. 2-United Bank of India. Learned counsel further submits that the appellant had deposited the amount with the ARCIL, which is assignee of the respondent-State Bank of India. The appellant has settled the matter with the ARCIL, therefore, the amount received from the auction purchaser is to be refunded by the respondent no. 2-United Bank of India to the appellant, who had auctioned the property. It is contended that the said issue was framed before the Tribunal below, but the same has not been decided, therefore, the matter may be remanded back to the Tribunal below for deciding the same.
Learned counsel for the respondent-Bank seeks time to take instruction in this regard by the next date.
