It has been intimated that the appellant has already been deposited Rs. 40.00 lacs by way of demand draft no. 670128 dated 15.05.2023 towards pre-deposit.
Learned counsel for the respondent-Auction Purchaser submits that the appellant is required to deposit 50% of the amount due as per the judgment passed by the Hon’ble Apex Court in Civil Appeal No. 8969 of 2022- M/s Sidha Neelkanth Paper Industries Private Limited & Another Vs. Prudent ARC Limited & Others decided on 05.01.2023. Reply to the waiver application has already been filed on behalf of the respondent-Auction Purchaser, to which the appellant may file rejoinder by the next date.
