Heard the learned counsel for the respondent-Bank on the recall application being I.A. No. 321/2023.
A prayer has been made to recall the order dated 22.07.2022, whereby the opportunity of the bank to file reply was closed as no reply was filed by the bank inspite of several opportunities being granted.
In the said application, it has been stated by the learned counsel for the respondent-bank that on account of heart ailment, he could not prepare and send the reply to the authorized officer for signing the same, therefore, the reply could not be filed and one opportunity is being sought for.
In view of the above, the recall application filed by the Bank is allowed. Let the respondent-Bank file reply by the next date, failing which no further opportunity will be given.
List this case on 11.03.2024 for reply.
