I.A. No. 1/2022 is an application for amending the counter claim which was filed as an Original Suit No. 1086/1991 before the Hon’ble High Court of Bombay and later transferred to the Debts Recovery Tribunal, (D.R.T).
The Appellant had earlier mistakenly carried out the amendment in the copy of the aforesaid plaint accompanying the appeal memorandum. That amendment was recalled and the R & P was called for from the DRT.
The application would therefore have been considered afresh with regard to the amendment that is to be carried out to the suit/counter claim.
The Ld. Counsel appearing for the Appellants is directed to verify the record and find out the counter claim from the R&P. Post on 11.12.2023 for hearing.
