Learned counsel for the respondent no. 3 submits that the main contesting parties are the respondent nos. 1 & 2, who have never appeared despite service of notice and no order for ex-parte has been passed till date.
The record shows that no one has ever put in appearance on behalf of the respondent nos. 1, but on behalf of the respondent no. 2 Shri Jahagir Hyder, Advocate did appear, but he has not appeared recently.
In view of the above, let the respondent nos. 1 & 2 be proceeded ex-parte, if they do not appear by the next date.
