Present: Shri Sandeep Arora, counsel for the appellant, Shri Nishant Mehrotra, counsel for the respondent no. 1,
Heard the learned counsel for the appellant.
Issue notice to the respondents no. 2 by two modes i.e. Registered Post with A.D. and Speed Post. Steps to be taken by the appellant within a week. Affidavit of service along with tracking report be filed by the next date.
Learned counsel for the appellant states that there is a direction of the Tribunal below for restoring the physical possession of the property in question, therefore, the interest of the appellant-Bank may be protected keeping regarding that part of the order impugned.
Learned counsel for the respondent no. 1 submits that the possession has already been taken by the respondent no. 1 and he prays for some time to file reply. Let the same be filed by the next date.
Learned counsel for the respondent no. 2 may also file reply.
List this case on 14.09.2023 for service. Till then, all the parties concerned are directed to maintain the status quo qua the property in question as it exists today.
