Learned counsel for the appellant submits that the arguing counsel Shri Prabhav Srivastava is unable to come today due to some personal difficulty, therefore, he seeks adjournment.
The office report dated 20.11.2023 shows that no reply has been filed by the respondent-bank to the waiver and delay condonation applications inspite of earlier order dated 21.04.2023, whereby it was directed that in case the Bank does not filed reply, the opportunity to file reply shall stand closed as the appeal is of year 2017. Since no reply has been filed, therefore, the opportunity of the respondent-Bank to file reply stands closed.
List this case on 19.02.2024 for hearing on waiver/limitation.
