and documents produced by Appellant are in support of the plea that the Appellant is no more a Director of Company from 01.02.2006 or at best from 01.02.2007. As rightly pointed out by Advocate for Bank, evidence and documents relating to his resignation, are no way relevant, since the Guarantee Agreement is, in his personal capacity, but, not as a Director of Company. As already referred to above, he is not even referred as Director of Company, in the preamble of the Agreement, and under his signature also, there is no stamp of Company as Director; whereas, for the other signature, stamp of Company is appended indicating him as Managing Director, therefore, the entire arguments of Advocate for Appellant based on the fact that Appellant resigned from directorship and no more concerned with Company on or after 01.02.2007, the date on which he is removed from Board of Directors, is no way relevant. As rightly pointed out by Bank, Appellant is not relieved, for the claim of the Bank in view of terms and conditions incorporated in Exhibit A27 document.
