Learned counsel for the appellant submits that the appellant was abroad, therefore, steps could not be taken for service of notice upon the respondent no. 2 through paper publication and prays that one further opportunity may be granted to take steps as per earlier order. Let the appellant take steps within three days for service of notice upon the respondent no. 2 as per earlier order dated 17.04.2023. Affidavit of service along with proof of publication be filed by the next date.
No reply has been filed on behalf of the respondent-bank as per office report dated 19.07.2023. Let the same be filed by the next date, failing which appropriate order shall be passed.
