The office report dated 06.12.2023 shows that no steps have been taken by the learned counsel for the appellant for service of notice upon the respondent no. 3. Let the notices be issued to the respondent no. 3 by two modes i.e. Registered Post with A.D. and Speed Post. Steps to be taken by the appellant within a week. Affidavit of service along with tracking report be filed by the next date.
The said report further records that the contempt application being I.A. No. 956/2023, interim application being I.A. No. 954/2023, impleadment application being I.A. No. 712/2023 and amendment application being I.A. No. 711/2023 are pending consideration.
Learned counsel for the respondent-Bank submits that the Bank has already sent intimation to the appellant to collect the goods, who may do so, if so desired.
