Date: 05.01.2023 Shri V.K. Shukla, Ld. Counsel for the appellant is present. Ld. Counsel provides the court fee of Rs. 200 on Waiver Application and also mentioned the date in the memo of Appeal. Details of court fee is also mentioned in para 10. Defects reconciled. Proper court fee paid.
No pre deposit has been made. Waiver Application has been filed. As per the Demand Notice dated 30.08.2019 (page 94-95 of instant Appeal) dues as on 30.08.2019 was Rs. 1,83,12,678/=+ interest. It has been mentioned by the appellants in the Waiver Application that they had deposited Rs. 52,08,090.40 P after issuance of demand notice. Ld. Counsel states that he will argue this issue before Hon’ble Court.
The instant Appeal has been filed under section 18 of the SARFAESI Act against interim order dated 23.12.2022 of DRT, Jabalpur in S.A. No. 156/2020. Urgency Application (I.A. No. 06/2023), Waiver Application (I.A. No. 17/2023) have been filed along with the Appeal.
