The office report dated 19.12.2023 shows that no steps have been taken by the counsel for the appellant for service of notice upon the respondent nos. 2/1, 2/2, 2/3 and 2/4 as per earlier order dated 16.05.2023, whereby it was observed that if the appellant does not take steps, appropriate order shall be passed. As no steps have been taken by the appellant, the opportunity for taking steps is hereby closed.

The aforesaid report further records that the reply of the respondent no. 1 has been filed, to which no rejoinder has been filed by the appellant. Let the same be filed by the next date, failing which appropriate order shall be passed.

Learned counsel for the appellant submits that the writ petition is pending consideration before the Hon’ble High Court, therefore, the matter may be deferred. Learned counsel for the respondent-bank seeks time to verify the same.

List this case on 22.04.2024 for service.
