Heard both sides. The Ld. Counsel appearing for the Respondent has no objections in allowing the prayer 9 (b) to 9 (h) and 11 to be added to the existing Appeal Memorandum. Other prayers cannot be allowed because it is incorporating a new prayer that cannot be entertained at the appellate stage. The challenge in the appeal regarding the disposal of the S.A. in terms of consent is already challenged and has to be considered on its merits in this appeal.
Hence, the aforesaid amendment to the extent it is allowed shall be carried out within two weeks. The amended copy of the appeal memorandum shall be furnished to the counsel appearing for the Respondent.
Post on 16.03.2023 before the Registrar for reporting compliance of carrying out amendment.
