This appeal is coming up today for reporting compliance of statutory deposit.

As per conditional order dated 25.9.2023 passed in IA 343/2023(Waiver), appellant shall deposit a sum of Rs.72,10,370/- on or before 9.10.2023 and failure to deposit the same would result in dismissal of appeal. However, appellant without complying the said order filed IA 396/2023 seeking extension of time of two months for compliance of conditional order dated 25.9.2023. However, on request of advocate for appellant, four weeks time was considered and granted and time was extended for deposit of amount till 6.11.2023 vide order dated 10.10.2023. Without complying the said order, appellant again sought further time of two weeks through IA 465/2023 and the said request was considered and time was extended as prayed for till 20.11.2023 vide order dated 7.11.2023 and posted to this date for compliance.

Today Ld. Counsel for appellant submitted that appellant could not comply with the conditional order dated 25.9.2023.

Considering the above referred events, Appeal AIR (SA) 1039/2023 is rejected, by giving effect to orders dated 25.9.2023, 10.10.2023 and 7.11.2023 for non compliance of statutory deposit.
