Heard the learned counsel for the appellant.
The present appeal has been filed under section 18 of the SARFAESI Act against the final order dated 29.09.2021 passed by the DRT, Jabalpur in S.A. No. 279/2021. The report of the Registrar shows that the I.A. No. 702/2022 being delay condonation application is pending consideration. The present appeal has been filed by the auction purchaser on the ground that the Bank and the borrower without making appellantAuction Purchaser as party in the S.A. No. 279/2021 before the Tribunal below settled the matter without knowledge of the appellant, although, the appellant was a necessary party in the said proceeding.
Issue notices to the respondents on the delay by two modes i.e. Registered Post with A.D. and Speed Post. Steps to be taken by the appellant within a week. Affidavit of service along with tracking report be filed by the next date.
