Learned counsel for the appellant contends that the S.A. proceedings initiated by the Bank is barred under the RDB Act, 1993, therefore, the present appeal has rightly been filed without making pre-deposit.
Learned counsel for the respondents shall response to the said submission by the next date. The Learned counsel further submits that the appeal is not maintainable on the ground that no pre-deposit has been made by the appellant.
Learned counsel for the respondent-Auction Purchaser seeks time to file reply. Let the same be filed by the next date.
List this case on 20.03.2023 for service. Till then the interim order, if any, shall continue.
