THE APPELLATE TRIBUNAL :

Misc. Application Dy. No. 650 of 2023 is filed by the Appellant for permission to make deposit of Rs. 7 lacs in compliance of the order dated 31st January, 2023 and also to recall the order dated 5th June, 2023 dismissing the Appeal in default of making pre- deposit.
Copy is served upon the Respondent’s Counsel. Learned Counsel for the Appellant is present. It appears that an order for making pre-deposit of 30% of the demanded due was passed on 31st January, 2023. But the compliance of the same was not made. Accordingly, Appeal was dismissed on 5th June 2023 for want of making pre deposit.
