Counsel also provides more legible copy of page number 155-159 and also undertakes that if court desires he will provide typed copy of the same. Defects reconciled. Proper court fee paid.
No pre deposit has been made. Waiver Application has been filed. As per the Possession Notice (page 55 of instant Appeal) dues as on 02.04.022 was Rs. 751.32 Lakh + interest. It has been stated in Para 15 of the Waiver Application that the secured assets have been sold by Bank and Rs. 9,13,60,000/= had been realized. Ld. Counsel states that he will argue this issue before Hon’ble Court.
The instant Appeal has been filed under section 18 of the SARFAESI Act against final order dated 21.12.2022 of DRT, Patna in S.A. No. 188/2022. Urgency Application (I.A. No. 761/2022), Waiver Application (I.A. No. 760/2022), Stay Application (I.A. No. 751/2022) have been filed along with the Appeal.
