The matter is taken up for hearing by way of a praecipe filed on 15.12.2023 by the Appellants seeking urgent relief.
The Ld. Counsel appearing for the Respondent seeks time to file a reply to the application for waiver of deposit.
The Ld. Counsel appearing for the Appellants apprehends that their residential property may be taken possession of once the stay is granted by the Hon’ble High Court of Gujarat till 22.12.2023 gets over. In the order of the Hon’ble High Court, it is made clear that the Respondent is to issue fresh notice and take steps in accordance with law after 22.12.2023, and therefore there is no immediate threat of dispossession to the Appellants. Hence, time is granted to file a reply to the application for waiver of pre-deposit.
The Ld. Counsel for the Respondent also undertakes that a proper notice will be served on the Ld. Counsel appearing for the Appellants before dispossession.
