M/S Khushi Seerwani and Daughters and Anr. versus Central Bank of India

I.A. No. 528/2023 is filed by the Appellants seeking an extension of time to make the 2^nd instalment payable towards the pre-deposit which was due to be paid, i.e. on or before 02.08.2023.

The Appellants were directed to make the pre-deposit of ₹ 20 lakhs. They have already made a payment of ₹ 10 lakhs and the 2^nd instalment of ₹ 10 lakhs is due for payment. The Appellants seek three weeks more to pay the amount.

The Ld. Counsel appearing for the Respondent Bank vehemently opposed the application for an extension of time. Exercising jurisdiction of this Tribunal u/s 19 (25) of the Recovery of Debts and Bankruptcy Act, 1993 ( RDB Act for short) and u/s 148 of the CPC, time is granted for payment of the 2^nd instalment of

the pre-deposit is extended by two weeks more. The amount shall be payable on or before 17.08.2023.

There shall be no further extension of time. The Appeal shall stand dismissed in case the order is not complied with. Post on 18.08.2023 for reporting compliance.
