The matter is taken up for hearing by way of a praecipe filed by the Appellants for seeking urgent relief.
The Appellants is in appeal impugning the order dated 09.1.2023 in I.A. No. 357/2022 in O.A. No. 1415/2016 on the files of the Debts Recovery Tribunal – I, Mumbai. (D.R.T). There is a delay of 26 days in filing the appeal which has been pointed out by the office.
The Appellants have explained the delay in the application. The Respondent has opposed the application on the ground that no sufficient reason has been mentioned.
On going through the application and the rival submissions, I find that the delay has been properly explained and hence, need to be condoned. The delay is condoned and the appeal shall be taken on file if there are no other defects to be cured.
Post on 11.10.2023 before Registrar.
