Shri Maneesh Mehrotra, Ld. Counsel for the appellant is present. Certified copy of the impugned order has been filed.

It is submitted by the Ld. Counsel that so far as affidavit along with Stay Application is concerned, the same is not required as interim relief has been prayed in the memo of Appeal which is duly supported by Affidavit.

It is further submitted that the Appeal is within limitation as the certified copy of the impugned order dated 18.02.2023 was received by the Bank on 20.03.2023. Illegible pages are not relevant for the purposes of the case, however, the counsel undertakes to produce original copy if required at the time of the argument.

The Ld. Counsel for the appellant prayed that the matter be placed before the Hon’ble Court.

The present appeal has been filed by Bank under section 18 of the SARFAESI Act against the final order dated 18.02.2023 passed by DRT, Patna in S.A. No. 33/2023. Urgency Application (I.A. No. 305/2023) and Stay Application (I.A. No. 306/2023) has been filed.

List this case before Hon’ble Chairperson on 27.04.2023 for further order.
