The matter is taken up for hearing by way of Praecipe filed by the Appellant seeking urgent relief.
It is submitted that Respondent No.1 is an assignor of the debt to Respondent No.3 and therefore, the Ld. Counsel appearing for the Appellant seeks notice to Respondent No.1 be dispensed with.
The prayer is allowed at the rest of the Appellants as regards the 2nd Respondent it is the dead person and the dead person cannot be an arrayed as a party in the appeal.
The Appellant is directed to make out the necessary amendment to the Appeal Memorandum and the application for condonation of delay.
Post on 16.05.2023 for a reply on I.A. No.186/2023 (CoD).
