Present: Shri Bablu, Advocate holding brief of Shri Raj Kumar Tiwari, counsel for the appellant,
Learned counsel for the appellant submits that the arguing counsel Shri R. K. Tiwari is out of station, therefore, he prays for adjournment.
The office report dated 28.03.2023 shows that no pre-deposit has been made inspite of several opportunities being granted to the counsel for the appellant. In case, the appellant does not deposit 25% of the amount due, which is mandatory in nature, by the next date, the appeal shall be considered as not entertainable and accordingly the same shall stand disposed off for want of mandatory pre-deposit without further reference to this court. If the said amount is deposited by the appellant within the stipulated period, list this case on 05.07.2023 for hearing on waiver of the rest 25% of the amount due.
