As per Order dated 08.09.2023, Appellants have to deposit Rs.1,10,86,139/-, on or before 22.09.2023, failing which, the Appeal shall stand rejected, and for compliance, the matter is posted to 25.09.2023.
Appellants filed IA 369/2023 for extension and that Petition is allowed on 25.09.2023, and four weeks’ time is granted, as prayed for in the Affidavit, till 23.10.2023, and posted the matter for compliance to 26.10.2023. But, Appellants have not complied with Order dated 25.09.2023. As Chairperson was on leave on 26.10.2023, the matter is reposted to this date.
Advocate for Appellants represented that extension Petition is filed seeking further time. As no such Application is listed today, matter is passed over, for verification, and on verification, it is noticed that the Appellants filed a Petition on 27.10.2023, i.e. after expiry of time fixed for payment.
As per conditional Order, if money is not deposited on or before 23.10.2023, Appeal shall stand rejected. As extension Petition is not filed before 23.10.2023, conditional Order has to be given effect.
In view of same, Appeal A.IR:95/2023 is rejected for non compliance of Orders dated 08.09.2023 and 25.09.2023.
