Learned counsel for the appellant Shri Sahil Srivastava is present. Defects reconciled.
Learned Counsel for the appellant has filed a fresh Waiver Application (I.A. No. 434/2023) along with the Demand Draft No. 715377 dated 20.04.2023 (Indian Bank) for an amount of Rs. 1526005/- towards 25% of pre-deposit. The outstanding in terms of impugned judgment dated 08.02.2022 is Rs. 6104011 (at page No. 45) the appellant had further prayed that due to serious financial constrained the business has been hampered during the Covid-19 and he has suffered huge financial hardship, hence, moved present Waiver Application.
The present appeal has been filed by Bank under section 18 of the SARFAESI Act against the final order dated 08.02.2022 passed by DRT, Allahabad in O.A. No. 908/20212. Delay Condonation Application (I.A. No. 403/2023) Early Hearing Application (I.A. No. 404/2023) Stay Application (I.A. No. 405/2023) has been filed.
