Present: Shri Alok Rai, counsel for the appellant-Bank, None for the respondents,
Learned counsel for the appellant contends that the respondents do not appear and the possession had to be handed over to the borrower by misinterpreting the order of the Tribunal below. It is further contended that a liberty may be given to the appellant-Bank to move an appropriate application before the Tribunal below for restoration of possession, which may be considered by the Tribunal below within the time as stipulated by this Tribunal.
As prayed, the appellant-Bank may move an appropriate application before the Tribunal below for redresssal of its grievance, if any, regarding possession of the property in question. If such application is moved by the appellant, the Tribunal below shall consider and decide the same strictly in accordance with law most expeditiously preferably within one month from the date of production of certified copy of this order.
