Ld. Counsel, Mr. Soumya Roy along with Mr. Santosh Mahato are present and submits that the delay in filing affidavit of service has been caused due to subsciquent event after the filing of this appeal. An NCLT application filed against M/s Epitome Petrochemical Pvt Ltd, Respondent No.1 in the appeal in this DRAT, has been admitted as on 05-04-2022 and moratorium has been commenced. A supplementary affidavit in this regard is filed on date annexing the order of the Hon’ble NCLT, Kolakata Bench. Ld. Counsel, for appellant undertakes to served copy of the paper books upon the rest of the respondents.
It is observed from the record that despite of several rounds of listing appellant is yet to comply order dated 04-07-2022, for submission of affidavit of service.
The matter may be placed before Hon,ble Chairperson on 13.09.2022 for direction.
