The case has been taken-up today on the basis of urgency application filed by the appellant along with the application for withdrawal of the appeal.
For the reason stated in the urgency application, the same is allowed.
Heard the learned counsel for the appellant on the application for withdrawal of the appeal.
An I.A. No. 77/2022 has been filed by the appellant for withdrawal of the present appeal on the ground that the present appeal has been filed against an interim order dated 01.11.2021 passed by the learned Presiding Officer, DRT, Lucknow in S.A. No. 746 of 2019. The learned counsel for the appellant submits that the S.A. No. 746/2019 has now finally been decided by the DRT, Lucknow vide judgment and order dated 27.04.2022, therefore, the present application has been filed for withdrawal of the appeal.
In view of the aforesaid, the present application is allowed and the appeal is dismissed as withdrawn.
