Present: Shri Kushal Kant, counsel for the appellant, Shri S. K. Pandey, counsel for the respondent-Bank,
Perusal of the earlier order dated 11.04.2022 shows that substitution application was filed by the appellant for substituting the legal heirs of the deceased appellant.
Substitution application is allowed. Let the necessary substitution be made by the appellant in the array of party by the next date.
The office report dated 03.08.2022 shows that proof of publication with regard to service of notice upon the respondent no. 3 has been filed, but no one has put in appearance on behalf of the said respondent. Respondent no. 3 may put in appearance and file reply by the next date, if so desired.
The said report further shows that no reply has been filed on behalf of the respondents no. 1 & 2 inspite of several opportunities being granted. As last opportunity, the respondent nos. 1 & 2 may file reply, failing which appropriate order shall be passed.
